Acceptable Use Policy
Fleksa, Inc. Effective: December 2024
This Acceptable Use Policy ("AUP") supplements the Terms & Conditions and describes uses of the Services that are prohibited. Violations may result in suspension or termination.
1. General Requirements
- Use only for lawful business purposes
- Compliance with all applicable federal, state, and local laws (including FDA, USDA, alcohol/tobacco licensing, ADA, FTC, COPPA, TCPA, CAN-SPAM, state privacy laws)
- Accurate registration and business information
2. Prohibited Content
You may not use the Services to host, sell, advertise, or distribute:
- Illegal, infringing, or fraudulent content
- Content that violates third-party intellectual property, publicity, or privacy rights
- Hateful, harassing, threatening, or discriminatory content
- False or misleading advertising; deceptive pricing
- Goods or services requiring a license you do not hold (e.g., alcohol sales without a valid liquor license)
- SHAFT-C content over SMS channels (sex, hate, alcohol, firearms, tobacco, cannabis)
3. Prohibited Conduct
- Circumventing security controls, scraping, or unauthorized access
- Reverse engineering, decompiling, or copying the Services
- Sending spam, unsolicited bulk email, or non-consented SMS
- Sending SMS, MMS, or voice communications without prior express written consent under TCPA
- Manipulating reviews, order counts, or other platform metrics
- Using the Services to benchmark against Fleksa or its competitors
- Distributing malware, viruses, or harmful code
- Stress-testing or denial-of-service activity against the platform
4. Guest Communications (TCPA / CAN-SPAM)
When you use Fleksa to message your guests:
- Maintain auditable proof of opt-in for each recipient
- Honor STOP / UNSUBSCRIBE requests immediately
- Comply with 10DLC registration, CTIA Messaging Principles, and carrier content rules
- Disclose sender identity and provide a working return address in marketing email
- You are solely responsible for TCPA, CAN-SPAM, and state little-TCPA compliance; you indemnify Fleksa accordingly
5. AI Features
- Review AI-generated content before publication
- Do not use AI features to create deceptive, defamatory, or unlawful content
- Do not use AI features to infringe third-party trade secrets or IP
- Do not attempt to extract training data, system prompts, or model weights
6. Consequences of Violation
We may, at our discretion:
- Request remediation within a reasonable timeframe
- Suspend access to specific features
- Suspend the entire account
- Terminate the master agreement for cause
7. Reporting

8. Changes
We may update this AUP with 30 days' notice when required by law, security, or operational necessity.
